Terms of Service

The core rules for using Astra

These Terms of Service ("Terms") govern your access to and use of the Astra website, mobile and desktop applications, API, and embedded widgets (together, the "Platform"). The Platform is operated by Sunstone Venture Capital LLC, doing business as Sunheir Culture ("Astra", "we", "us", "our"; address: [Sunstone Venture Capital LLC, address — fill in], United States). By creating an account or otherwise using the Platform you agree to these Terms and to our Privacy Policy, Cookie Policy, Community Guidelines, Acceptable Use Policy, Subscription Terms, Refund Policy, Astrology & Divination Disclaimer, Voice AI Disclosure, Safety & Age Policy and (if you are a reader or live broadcaster) the Reader Agreement and Live Streaming Rules.

If you do not agree, do not use the Platform.

1. Eligibility

  • You must be at least 13 to create an account. In jurisdictions with a higher digital-consent age — including most of the European Union (the GDPR-K minimum is 16, lower in some member states), the United Kingdom (13), South Korea (14), Australia (varies by state) and similar regimes — you must meet that local minimum or provide verifiable parental consent.
  • Users under 18 are restricted to "Explore" features (read-only Cosmos, public live streams, brand follows). Direct messages, resonance, voice readings, gift transactions, marketplace bookings, and live broadcasting require 18+.
  • You agree that the information you give us (age, location, name) is accurate. We may verify your age where required by law and we may suspend accounts that misrepresent eligibility.
  • One human per account. Accounts are personal and non-transferable.

2. Your account

You are responsible for everything that happens under your account. You must keep your password and authentication factors confidential and notify us immediately at hello@astraplatform.ai if you suspect unauthorised access. We use industry-standard security but we cannot guarantee that unauthorised access will never occur.

3. Acceptable use

You agree not to:

  • Use the Platform for any unlawful purpose, to harass, defame, or threaten any person, or to violate intellectual-property rights.
  • Scrape, crawl, mirror, frame, or systematically copy the Platform except via published APIs under separate written agreement.
  • Use automated means (bots, scripts, headless browsers) to access the Platform except for accessibility tools and search-engine indexers obeying our robots.txt.
  • Resell, sublicense, or commercially redistribute any part of the Platform without our written consent.
  • Reverse-engineer or attempt to extract source code, model weights, or proprietary prompts, except to the extent permitted by applicable law (e.g. EU Directive 2009/24/EC art. 6).
  • Probe, scan, or test the vulnerability of the Platform without written authorisation via our security-disclosure programme.
  • Upload malware, send spam, or perform denial-of-service attacks.
  • Use the Platform to develop a competing product or to train a competing AI model.

4. Content you submit ("User Content")

You retain ownership of the content you submit (questions, journal entries, photos, audio, video, profile data, reviews). You grant Astra a worldwide, non-exclusive, royalty-free, sublicensable licence to host, store, reproduce, adapt, transcode, translate, publish, perform, and display that content solely to operate, promote, secure, and improve the Platform, including in derivative formats such as clips and previews. The licence terminates when you delete the content, subject to (a) cached copies and backups that expire within 90 days and (b) content you have shared with other users that they have already received.

You represent that you own or have permission to share any content you upload and that it does not violate third-party rights or our Community Guidelines.

We do not claim ownership of your birth chart, journal entries, or any spiritual / personal information you supply.

5. AI-generated content

The Platform includes AI-generated readings, voice personas, chart interpretations, and content suggestions ("AI Output"). AI Output is automatically generated, may be inaccurate or incomplete, is not professional advice, and is provided for self-reflection and entertainment purposes only. AI Output does not constitute medical, psychiatric, psychological, legal, financial, tax, or relationship counselling. You are solely responsible for any decisions you make based on AI Output. 6. Marketplace (Readers, Live, Gifts)

Astra operates a marketplace through which independent readers, live broadcasters, and other creators offer services and content to other users (collectively, "Creators"). Astra is a neutral platform and is not a party to any individual transaction between you and a Creator — except as expressly stated in the Reader Agreement and Live Streaming Rules. Creators are independent contractors, not Astra employees or agents.

  • Standard revenue split: Creator receives 70%, Astra retains 30% to cover payment processing, infrastructure, trust & safety, and platform development.
  • Payouts to Creators are made in arrears, monthly, via Stripe Connect, subject to a $50 minimum balance and a 7-day dispute hold.
  • Creators are solely responsible for their own tax reporting (we file IRS Form 1099-K where required for US-resident creators above threshold, and collect IRS Form W-9 or W-8BEN at onboarding).
  • Disputes between users and Creators are mediated by Astra Trust & Safety under the criteria in the Refund Policy; we are mediators, not arbitrators of personal grievances.

7. Subscriptions, coins, and other paid features

If you purchase a subscription, coins ("Stars"), gifts, or shop items, the Subscription Terms and Refund Policy apply. In short:

  • Subscriptions auto-renew until cancelled in Settings → Billing.
  • We email a renewal reminder at least 7 days before each renewal (or as required by your jurisdiction).
  • All sales are final except (a) the 14-day right of withdrawal for EU/UK consumers (and analogous rights elsewhere), and (b) the specific refund windows listed in the Refund Policy.
  • Stars are pre-paid platform credit, are not currency, and are non-refundable once redeemed.
  • Reader sessions are refundable within 24 hours only if the reader was a no-show; otherwise final.

8. Privacy and personal data

Our Privacy Policy explains what personal data we collect, why, how long we keep it, and what rights you have. Birth date, birth time, and birth location are sensitive ("special category") data under GDPR Art. 9 and we process them only with your explicit consent for the purposes you choose (computing charts, generating readings). You can withdraw that consent at any time in your account settings.

9. Termination

You may close your account at any time from Settings → Account → Delete Account. We may suspend or terminate your account, with or without notice, for material breach of these Terms, our Community Guidelines, or applicable law, or where required by a regulator or court order. After closure we retain a minimal record for 90 days to handle disputes, fraud, and regulatory requests; financial records are retained for 7 years.

10. Disclaimers and limitations of liability

THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ASTRA DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

TO THE FULLEST EXTENT PERMITTED BY LAW, ASTRA'S AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO YOUR USE OF THE PLATFORM IS LIMITED TO THE GREATER OF (A) USD 100 OR (B) THE AMOUNTS YOU PAID TO ASTRA IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL.

NOTHING IN THESE TERMS LIMITS OR EXCLUDES LIABILITY THAT CANNOT BE LIMITED OR EXCLUDED UNDER APPLICABLE LAW, INCLUDING LIABILITY FOR GROSS NEGLIGENCE, WILFUL MISCONDUCT, FRAUD, DEATH OR PERSONAL INJURY CAUSED BY OUR NEGLIGENCE, OR YOUR STATUTORY CONSUMER RIGHTS.

11. Indemnification

You agree to indemnify and hold harmless Astra, its officers, employees, and agents from any claim, loss, or expense (including reasonable attorneys' fees) arising from (a) your breach of these Terms, (b) content you submit, or (c) your violation of any law or third-party right. Astra retains the right to assume the exclusive defence of any matter for which you owe us indemnification.

12. Governing law and dispute resolution

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws principles, except where mandatory local consumer-protection law of your residence applies.

Any dispute arising under these Terms will be resolved by binding individual arbitration administered by JAMS under its Streamlined Arbitration Rules, seated in Wilmington, Delaware, in English, unless arbitration is unenforceable for your dispute. The arbitrator may not consolidate claims and may not preside over any form of class action.

EU / UK / EEA / Swiss / Brazilian / Australian / Korean / Japanese consumers retain the right to bring proceedings in the courts of their habitual residence and to rely on the mandatory consumer- protection rules of that residence. California residents retain small-claims-court rights. PRC users: a future PRC edition of the Platform will be governed by separate, PRC-law Terms.

You and Astra agree to attempt good-faith resolution by emailing hello@astraplatform.ai at least 30 days before commencing arbitration or litigation.

13. Force majeure

Neither party is liable for failure or delay caused by an event beyond reasonable control, including natural disaster, war, civil unrest, government action, network or utility failure, cyber attack, pandemic, or labour disruption.

14. Changes to these Terms

We may update these Terms. For material changes, we will email subscribers at least 30 days before the effective date and post a prominent notice on the Platform. Continued use after the effective date constitutes acceptance. If you do not accept the change you may close your account before the effective date.

15. Severability and entire agreement

If any provision of these Terms is held unenforceable, the remaining provisions remain in full force. These Terms, together with the documents referenced above, constitute the entire agreement between you and Astra and supersede any prior agreement on the same subject.
